STATEMENT BY THE POLITICAL BUREAU OF THE PCTE

ON THE INSTITUTIONAL CRISIS UNLEASHED AT THE STATE LEVEL

The Political Bureau of the Communist Party of the Workers of Spain (PCTE) is closely following the events that are taking place in the state superstructure and which, after the decisions adopted yesterday by the plenary session of the Constitutional Court, have unleashed a serious institutional crisis.

The refusal of the Popular Party to renew the judiciary and the measures taken by the governing parties to force that renewal confirm that the division of powers is a mere fiction. The ruling class neither shares nor admits limitations in the exercise of political power. Its internal disputes and contradictions are settled through the parliamentary game, in which each bourgeois political party tries to control and use the institutions to its own advantage.

The government knew that its intention to introduce amendments reforming the Organic Law of the Constitutional Court and the Organic Law of the Judiciary, incorporated into the Proposed Organic Law on the transposition of European Directives and other provisions for the adaptation of criminal legislation to the order of the European Union, and reform of crimes against moral integrity, public disorder and smuggling of dual-use weapons, was contrary to the doctrine of the Constitutional Court. With this, in line with the legal blunders committed in recent months, he facilitated, aware of the implicit risks, the legal manoeuvres of the right and the extreme right, who have never hesitated to use all available means to achieve their political objectives.

Both sides have an interest in tensing the political situation, even at the risk of unleashing a serious institutional crisis, at the start of an election year. The hyperbolic style employed by both sides, with cross accusations of fomenting a coup d'état, confirms this. Both are calling on the people to close ranks behind their positions. But all of them share the mallet of capitalist exploitation and the defence of the state and legal superstructure that sustains it, which is why, beyond electoral artifices, typical of the growing parliamentary cretinism we are suffering, they will not hesitate to reach the agreements that are necessary to preserve capitalist power.

While the representatives of power argue heatedly and share out the institutions, the working class and the popular sectors are seeing our living and working conditions decline. We must not allow ourselves to be trapped in false debates. Today those who have spent an entire legislature giving cover to the worsening of capitalist exploitation are disarming us politically and ideologically when they cynically try to mobilise us in defence of the state, the bourgeois order and the constitution. The solution for the broad social majorities does not lie, of course, in tolerating any reactionary turn. Nor does it lie in the modernisation of their democracy, which represents the less savage face of the capitalist class dictatorship against the working people. The solution to the people's problems will come from a political programme that overcomes capitalism and establishes a workers' and people's democracy based on the power of the working men and women of our country.

No more games at the expense of the people! Let them all go away! Let us rely only on our own strength! Let us organise the struggle for workers' power!

DECLARACIÓN DEL BURÓ POLÍTICO DEL PCTE

ANTE LA CRISIS INSTITUCIONAL DESATADA EN LA CÚSPIDE ESTATAL

El Buró Político del Partido Comunista de los Trabajadores de España (PCTE) sigue con atención los acontecimientos que se suceden en la superestructura estatal y que, tras las decisiones adoptadas ayer por el pleno del Tribunal Constitucional, han desatado una grave crisis institucional.

La negativa del Partido Popular a renovar el poder judicial y las medidas adoptadas por los partidos del Gobierno para forzar esa renovación confirman que la división de poderes es una mera ficción. La clase dominante no comparte ni admite limitaciones en el ejercicio del poder político. Sus disputas y contradicciones internas se dirimen a través del juego parlamentario, en el que cada partido político burgués trata de controlar y de utilizar en beneficio propio las instituciones.

El Gobierno conocía que su intención de introducir enmiendas reformando la Ley Orgánica del Tribunal Constitucional y de la Ley Orgánica del Poder Judicial, incorporadas a la Proposición de Ley Orgánica de transposición de directivas europeas y otras disposiciones para la adaptación de la legislación penal al ordenamiento de la Unión Europea, y reforma de los delitos contra la integridad moral, desórdenes públicos y contrabando de armas de doble uso, era contraria a la doctrina del Tribunal Constitucional. Con ello, en línea con las torpezas jurídicas cometidas durante los últimos meses, facilitó, consciente de los riesgos implícitos, las maniobras legales de la derecha y la extrema derecha, que nunca han dudado en emplear todos los medios disponibles para alcanzar sus objetivos políticos.

Tanto unos como otros están interesados en tensionar la situación política, aun a riesgo de desatar una grave crisis institucional, ante el inicio de un año electoral. El estilo hiperbólico empleado por unos y otros, con acusaciones cruzadas de fomentar un golpe de Estado, así lo confirman. Unos y otros llaman al pueblo a cerrar filar detrás de sus posiciones. Pero, todos ellos comparten el mazo de explotación capitalista y la defensa de la superestructura estatal y jurídica que la sustenta, por lo que más allá de artificios electorales, propios del creciente cretinismo parlamentario que padecemos, no dudarán en alcanzar los acuerdos que sean necesarios para preservar el poder capitalista.

Mientras los representantes del poder discuten acaloradamente y se reparten las instituciones, la clase obrera y los sectores populares vemos retroceder nuestras condiciones de vida y trabajo. No debemos dejarnos atrapar en falsos debates. Hoy nos desarman política e ideológicamente cuando cínicamente nos tratan de movilizar en defensa del Estado, el orden burgués y la Constitución quienes llevan una legislatura entera dando cobertura a la agudización de la explotación capitalista. La salida para las amplias mayorías sociales no está, por supuesto, en tolerar ningún giro reaccionario. Tampoco lo está en la modernización de su democracia, que representa la cara menos salvaje de la dictadura de clase capitalista contra el pueblo trabajador. La salida a los problemas populares vendrá de la mano de un programa político que supere el capitalismo e implante una democracia obrera y popular basada en el poder de los trabajadores y las trabajadoras de nuestro país.

¡Basta de juegos a costa del pueblo! ¡Que se vayan todos! ¡Confiemos sólo en nuestras propias fuerzas! Organicemos la lucha por el poder obrero.
