The measures adopted by the Government in the management of the Covid-19 health crisis have a deep class nature. The containment decreed through the Decree for the Establishment of the Alarm State last Saturday is limited by the need of the bourgeoisie to keep producing and thus the extraction of surplus value.

As a result, a large part of the working class and the rest of salaried workers are being forced to work, putting their health and the working-class families’ at risk in order to maintain the profits of the employers.

This situation is affecting in an unequal way to the different sections of the working-class majority, but it has been millions of workers forced to present themselves in their job post today, putting their health at risk in crowded means of public transportation, because of the possibility to adopt fines against them, including dismissals, if they were not present in their post.

If the right to health is a priority in these moments, it cannot be subdued to the interests of the employers.

The Decree adopted last Saturday has eased this dire situation, as it does not include any measure on health protection in workplaces. No measures have been adopted to reinforce Labor Inspection. It looks like the agreements to be adopted tomorrow in the Council of Ministers will be targeted to ease the suspension of millions of job contracts and the assumption of the costs of unemployment benefits that will be generated by the State. Likewise, it will establish tax aids and bonus in the employers’ contributions to the Social Security for all the companies in the country, without distinction between self-employed workers and big monopolies.

The Council of Ministers has neither wanted to establish complementary social measures for the working class as of mortgages, rents, or basic food and supplies assistance, among other things.

Today, the only way to assure the effective protection of the working-class health is by stopping the production. This morning’s images in the undergrounds in Madrid, Barcelona or Bilbao, or in Contact Centers, of those from deliverymen in many companies, talk by themselves. While institutions like the Parliament of the General Council of the Judiciary are stopped, the labor activity in the productive sectors is forced to continue.

The production stoppage should have been adopted last Saturday, establishing the banning to go work excepting for the strategic sectors. In these ones, the Decree should have decided the intervention of all the big companies, adopting some minimum services to assure the supplies, organizing the staff in turns and guaranteeing all the measures for health protection as a first step.

We are witnessing how thousands of companies are forcing their workers to use their holidays so they do not go to their posts. In other cases, massive lay-offs are made through EREs [1] and the non-renewal of temporary work contracts, most of them signed under an undisguised fraud. Now, the effects of not repealing the labor reforms are evidenced, as this crisis is confronted with the measures adopted to favor the employers in the previous crisis.

On the other side, the resort to ERTEs [2], largely used just like in the 2008 crisis, is a dangerous weapon in the hands of employers: regardless of how long the alarm state will take, companies will be able to extend any proceeding by pleading economic, organizational, technical or productive causes. Any difficulty or business pretext will be enough to go on suspending contracts or imposing new adjustments. The so-called inner flexibility in companies increases the entrepreneur dictatorship in workplaces and drives the ensemble of our labor rights back instead of preventing dismissals.

As the Government renounces to adopt the measures required to protect the life and physical integrity of the working-class majority in our country, and as the situation is one of serious and imminent risk for all the population after the adoption of the alarm state, it should be the workers, their trade-union organizations and their legal representative those who must step forward in the defense of their health. Only the people save the people.

Because of all of this, we demand:

-        The stoppage of the activities in all the companies but the strategic sectors, due to the serious and imminent risk for the health of the staffs.

-        The intervention of all the companies in the strategic sectors, assuring the minimum services and the health and safety of the affected staffs.

-        The stoppage of all the EREs and ERTEs in process.

-        Adoption of immediate measures like the moratorium in the payment of mortgages and rents, the approval of a basic assistance benefit for families without incomes or with a limited level of incomes, banning of any cut in the electric, water or heating supply.

-        Suspension of tax obligations for self-employed workers who have no hired workers.

-        Intervention of all the private health without any economic compensation.

In case of not adopting the basic measures to protect the health and safety of workers in their companies, assuring 100% of the wage, we call workers to use the tools foreseen in the Law for the Prevention of Occupational Risks, through their Personnel Delegates, the works councils or the prevention representative, in order to decide work stoppage due to serious and immediate risk. These facts should be brought to the attention of the Labor Inspection and the measures required to prevent any fine the company could think of should be adopted.

We will not pay this crisis with our health nor our rights.
Only the people save the people.

Ante el estado de alarma y la pasividad del Gobierno: paralicemos la producción

Las medidas que se están adoptando por parte del Gobierno en la gestión de la crisis sanitaria del Covid-19 tienen un profundo carácter de clase. El confinamiento decretado mediante el Decreto de establecimiento del estado de alarma del pasado sábado tiene como límite la necesidad de la burguesía de mantener la producción y, con ello, la extracción de plusvalía.

Como consecuencia, gran parte de la clase obrera y el resto de trabajadores asalariados están siendo obligados a trabajar, poniendo en riesgo su salud y la de las familias obreras, para mantener las ganancias de la patronal.

Esta situación está afectando de manera desigual a los distintos sectores de la mayoría trabajadora, pero hoy han sido millones los trabajadores y trabajadoras que se han visto obligados a presentarse en su puesto de trabajo, arriesgando su salud en vehículos de transporte público abarrotados, ante la posibilidad de adopción de sanciones contra ellos, incluidos los despidos, en caso de no presentares al trabajo.

Si el derecho a la salud es la prioridad en estos momentos, éste no puede quedar sometido a los intereses patronales.

El Decreto aprobado el pasado sábado, al no incluir ninguna medida sobre protección de la salud en los centros de trabajo, ha facilitado esta grave situación. Ni siquiera han adoptado medidas para reforzar la Inspección de Trabajo. Todo apunta a que los acuerdos que se aprobarán mañana en el Consejo de Ministros irán encaminados a facilitar la suspensión de millones de contratos de trabajo y la asunción por parte del Estado de los costes de las prestaciones por desempleo que se van a generar. Igualmente, establecerá ayudas fiscales y bonificaciones en las cotizaciones patronales a la Seguridad Social a todas las empresas del país, sin distinguir entre trabajadores autónomos y grandes monopolios.

El Consejo de Ministros tampoco ha querido establecer medidas sociales complementarias a favor de la clase obrera relativas a hipotecas, alquileres, asistencia básica alimentaria y de suministros, entre otras.

Hoy, la única forma de garantizar la protección efectiva de la salud de la clase obrera es paralizando la producción. Las imágenes de esta mañana en el Metro en Madrid, Barcelona o Bilbao, o de los Contact Center, o de los repartidores de muchas empresas hablan por sí solas. Mientras paran instituciones como las Cortes o el Consejo General del Poder Judicial, se obliga a mantener la actividad laboral en los sectores productivos.

La paralización de la producción debería haber sido adoptada el pasado sábado, estableciendo la prohibición de acudir al trabajo excepto en los sectores estratégicos. En éstos, el Decreto debería haber decidido la intervención de todas las grandes empresas, adoptando como primera medida unos servicios mínimos para garantizar los suministros, organizando a las plantillas por turnos y garantizando todas las medidas de protección de la salud.

Estamos viendo cómo miles de empresas obligan a los trabajadores y trabajadoras a utilizar sus vacaciones para no acudir a sus puestos. En otros casos, se producen despidos masivos a través EREs o de la no renovación de contratos de trabajo temporales, firmados en su mayoría en abierto fraude de ley. Ahora se comprueban los efectos de no derogar las reformas laborales, pues se afronta esta crisis con las medidas aprobadas para favorecer a la patronal durante la crisis anterior.

Por otra parte, el recurso a los ERTEs, utilizado masivamente como se hiciera en la crisis de 2008, es un arma peligrosa en manos de la patronal: independientemente de cuánto dure el estado de alarma, las empresas podrán alargar cualquier expediente de regulación alegando causas económicas, organizativas, técnicas o de producción. Bastará cualquier dificultad o pretexto empresarial para mantener los contratos suspendidos o imponer nuevos ajustes. La denominada flexibilidad interna en las empresas, lejos de evitar los despidos, intensifica la dictadura empresarial en los centros de trabajo y hace retroceder el conjunto de nuestros derechos laborales.

Dado que el Gobierno renuncia a adoptar las medidas necesarias para proteger la vida y la integridad física de la mayoría trabajadora de nuestro país, y dado que la situación es de riesgo grave e inminente para toda la población tras la aprobación del estado de alarma, son los trabajadores y trabajadoras, sus organizaciones sindicales y sus representantes legales en las empresas, quienes tienen que dar el paso en defensa de su salud. Sólo el pueblo salva al pueblo.

Ante todo esto, exigimos:

– Paralización de las actividades de todas las empresas, salvo los sectores estratégicos, por riesgo grave e inminente para la salud de las plantillas.

– Intervención de todas las empresas de sectores estratégicos, garantizando los servicios mínimos y la salud y seguridad de las plantillas afectadas.

– Paralización de todos los EREs y ERTEs en marcha.

– Adopción de medidas inmediatas como la moratoria en el pago de las hipotecas y alquileres; la aprobación de una prestación asistencial básica para familias sin ingresos o con un nivel de ingresos limitados, prohibición de cualquier corte en el suministro eléctrico, de agua o de calefacción.

– Suspensión de las obligaciones fiscales para los autónomos sin trabajadores contratados.

– Intervención de toda la sanidad privada sin compensación económica alguna.

En el caso de que no se adopten las medidas básicas para proteger la salud y seguridad de los trabajadores en las empresas, garantizando el 100% del salario, llamamos a los trabajadores y trabajadoras a que utilicen las herramientas que prevé la Ley de Prevención de Riesgos Laborales, a través de los delegados de personal, de los comités de empresa o de los delegados de prevención, para decidir la paralización del trabajo por riesgo grave e inminente, poniendo estos hechos en conocimiento de la Inspección de Trabajo y adoptando las medidas de necesarias para impedir cualquier sanción que la empresa pueda plantearse.

No pagaremos esta crisis con nuestra salud ni con nuestros derechos.
Sólo el pueblo salva al pueblo.
