The Federal Constitutional Court today granted the complaint of the German Communist Party against its non-admission to the Bundestag elections and the deprivation of its status as a political party.

Patrik Köbele, chairman of the DKP, states:

"The Federal Constitutional Court today rejected the attempt to endanger the existence of the German Communist Party (DKP) by bureaucratic means and to ban it from standing in the Bundestag elections.

The reasoning for the judgement is a slap in the face for the Federal Election Commissioner and also confirms that the DKP is an active political party, for example, reference is made to the DKP's rally on the 80th anniversary of the assault on the Soviet Union.

This decision is not only the result of our legal and political argumentation, but above all the result of the great national and international solidarity we have experienced. Especially the international solidarity has exceeded all our expectations. More than 50 communist and workers' parties, the World Peace Council, the World Federation of Democratic Youth and many progressive organisations have shown solidarity with us. This was a great demonstration of internationalism. Everywhere this attempt of reactionary forces was made public. MPs from sister parties made use of the EU-Parliament to support the DKP. We are proud to be part of this internationalist community. We thank you from the bottom of our hearts! This example shows how important solidarity is and what it can achieve.

For us, this solidarity and success are a mandate to go into the election campaign with all our strength, to fight for our political contents and for the strengthening of the DKP - now more than ever.

The victory for the DKP is also a small stage victory in the struggle against the dismantling of democratic rights, against the reactionary restructuring of the state – against this we have to continue to fight together.

Long live proletarian internationalism!"

Конституционный суд отклонил нападки на ГКП

Федеральный конституционный суд сегодня удовлетворил жалобу Германской коммунистической партии на недопуск к выборам в Бундестаг и лишение ее статуса политической партии.

Патрик Кёбеле, председатель ГKП, сказал:

"Федеральный конституционный суд сегодня отклонил попытку бюрократическим путем поставить под угрозу существование Германской коммунистической партии (ГKП) и запретить ей участвовать в выборах в Бундестаг.

Доводы суда являются звонкой пощечиной для федерального избирательного комиссара, а также подтверждают, что ГKП является активной политической партией, ссылаясь, например, на митинг ГKП, посвященный 80-й годовщине вторжения в Советский Союз.

Это решение является не только результатом нашей юридической и политической аргументации, но, прежде всего, результатом большой национальной, а также международной солидарности, которую мы испытали. Особенно международная солидарность превзошла все наши ожидания. Более 50 коммунистических и рабочих партий, Всемирный совет мира, Всемирная федерация демократической молодежи, многие прогрессивные организации проявили солидарность с нами. Это был прекрасный пример интернационализма. Повсюду эта попытка отреагировать была предана огласке. Депутаты от братских партий использовали парламент ЕС для поддержки ГKП. Мы гордимся тем, что являемся частью этого интернационалистического сообщества. Мы благодарим вас за это от всего сердца! Этот пример показывает, насколько важна солидарность и что она может достичь.

Для нас эта солидарность и успех являются поручением вступить в избирательную кампанию со всей нашей силой, бороться за наши политические цели и укреплять ГКП - сейчас, как никогда раньше.

Эта победа ГКП также является маленькой этапной победой в борьбе против демонтажа демократических прав, против реакционной реструктуризации государства - здесь мы должны продолжать бороться вместе.

Да здравствует пролетарский интернационализм!"

El Tribunal Constitucional rechaza el ataque al DKP

El Tribunal Constitucional Federal confirmó hoy la demanda del Partido Comunista Alemán contra su no admisión a las elecciones al Bundestag y contra la privación de su estatus de partido político.

Patrik Köbele, presidente del DKP, declara:

"El Tribunal Constitucional Federal ha rechazado hoy el intento de poner en peligro la existencia del Partido Comunista Alemán (DKP) por medios burocráticos y de prohibirle presentarse a las elecciones al Bundestag.

Lo que considera el TCF es una sonora bofetada para el Comisario Federal de Elecciones y además confirma que el DKP es un partido político activo; por ejemplo, se hace referencia al mitin del DKP en el 80º aniversario de la invasión de la Unión Soviética.

Esta decisión no es sólo el resultado de nuestra argumentación jurídica y política, sino sobre todo el resultado de la gran solidaridad nacional e internacional que hemos experimentado. Especialmente la solidaridad internacional ha superado todas nuestras expectativas. Más de 50 partidos comunistas y obreros, la Federación Mundial por la Paz, la Federación Mundial de la Juventud Democrática, muchas organizaciones progresistas se han solidarizado con nosotros. Esto fue un gran ejemplo de internacionalismo. En todas partes se hizo público este intento de la reacción. Diputados de partidos hermanos utilizaron el Parlamento de la Unión Europea para apoyar al DKP. Estamos orgullosos de formar parte de esta comunidad internacionalista. ¡Se lo agradecemos de todo corazón! Este ejemplo muestra lo importante que es la solidaridad y lo que puede mover.

Para nosotros, esta solidaridad y este éxito son un mandato para entrar en la campaña electoral con toda nuestra fuerza, para luchar por nuestros contenidos políticos y por el fortalecimiento del DKP, ahora más que nunca.

La victoria del DKP es también una pequeña victoria de etapa en la lucha contra el desmantelamiento de los derechos democráticos, contra la reestructuración reaccionaria del Estado – en esto debemos seguir luchando juntos.

Das Verfassungsgericht weist Angriff auf die DKP zurück

Das Bundesverfassungsgericht hat heute der Klage der Deutschen Kommunistischen Partei gegen ihre Nichtzulassung zur Bundestagswahl und die Aberkennung des Status als politische Partei stattgegeben.

Dazu erklärt Patrik Köbele, Vorsitzender der DKP:

 „Das Bundesverfassungsgericht hat heute den Versuch, die Existenz der Deutschen Kommunistischen Partei (DKP) mit bürokratischen Mitteln zu gefährden und ihr die Kandidatur bei den Bundestagswahlen zu verbieten, zurückgewiesen.

Die Begründung ist eine schallende Ohrfeige für den Bundeswahlleiter und bestätigt außerdem, dass die DKP eine aktive politische Partei ist, so wird zum Beispiel auf die Kundgebung der DKP zum 80. Jahrestag des Überfalls auf die Sowjetunion verwiesen.

Dieser Beschluss ist nicht nur das Ergebnis unserer juristischen und politischen Argumentation, sondern vor allem ein Ergebnis der großen nationalen, wie internationalen Solidarität, die wir erfahren haben. Besonders die internationale Solidarität hat all unsere Erwartungen übertroffen. Über 50 kommunistische und Arbeiterparteien, der Weltfriedensrat, der Weltbund der demokratischen Jugend, viele fortschrittliche Organisationen haben sich mit uns solidarisiert. Das war ein großartiges Beispiel von Internationalismus. Überall wurde dieser Versuch der Reaktion öffentlich gemacht. Abgeordnete von Schwesterparteien nutzten das EU-Parlament, um die DKP zu unterstützen. Wir sind stolz Teil dieser internationalistischen Gemeinschaft zu sein. Wir bedanken uns dafür von ganzem Herzen! Dieses Beispiel zeigt, wie wichtig Solidarität ist und was sie bewegen kann.

Für uns sind diese Solidarität und der Erfolg ein Auftrag jetzt mit aller Kraft in den Wahlkampf zu gehen, um unsere politischen Inhalte und um die Stärkung der DKP zu kämpfen – jetzt erst recht.

Der Sieg für die DKP ist auch ein kleiner Etappensieg im Kampf gegen den Abbau demokratischer Rechte, gegen den reaktionären Staatsumbau – hier müssen wir gemeinsam weiterkämpfen.
